Appeal in robbery case dismissed

Trial court had sentenced the convict to seven years' imprisonment


NEW DELHI: The Delhi High Court has dismissed an appeal by a convict in a robbery case, holding that there is no merit in it. The Court also refused to interfere with the quantum of sentence.

The trial court had sentenced the convict, Pradeep Kumar, to seven years' imprisonment. The police had charged Kumar with robbing a man of a wrist watch and Rs.135 in cash by threatening him with razors when he was going towards New Delhi railway station in November 2000. There were also two other accomplices with Pradeep Kumar. They were also convicted by the trial court.

The patrol police had arrested all the accused on the spot with the help of some passers-by after the victim raised an alarm. The trial court had convicted the three on the basis of evidence by the victim and the police personnel involved in their nabbing and investigation.

The victim had identified the wrist watch as well as the currency notes recovered from the robbers in the court.

As regards evidence given by one of the police personnel involved in nabbing the robbers, Justice Sanjiv Khanna said he was lucid, clear and reliable, and the cross-examination did not dent his statements. Another policeman, who was also on patrol duty that day, reaffirmed the statements of his colleague.

“In view of the aforesaid findings, there is no merit in the present appeal and the same is accordingly dismissed. I also do not find any reason to interfere with the order on sentence as sentence of seven years' rigorous imprisonment is the minimum sentence prescribed under Section 397 IPC,'' Justice Khanna said.
