District Judges and DGP directed to crosscheck data

HC finds anomalies in list of pending cases maintained by police, magistrates

MADURAI: The Madras High Court Bench here on Wednesday directed Principal District and Sessions Judges across the State and the Director General of Police to crosscheck the data available with them to clear discrepancies in the list of pending criminal cases maintained by police stations and jurisdictional magistrates.

Justice S. Nagamathu gave the direction while disposing of a contempt of court petition filed by an individual against the Inspector of Karimedu police station here for disobedience of the court's order to complete the investigation in a criminal case and file a charge sheet within a time frame.

During the course of hearing, the judge found out that the list of pending criminal cases maintained by the Madurai city police did not match with the list submitted by a Judicial Magistrate here. Immediately, he summoned the Deputy Commissioner of Police R. Chinnasamy to explain the reason for the inconsistency.

After going through the two lists, the Deputy Commissioner submitted that many cases found in the list maintained by the Magistrate had already been closed by the police either as ‘action dropped' or for many other reasons.

He sought a copy of such lists maintained by all magistrates to clear the discrepancy. Recording the submissions made by the officer, the judge directed him to reconcile himself to the matter and make sure that final reports were filed in all pending cases. He also ordered the DGP to carry out a similar exercise across the State after obtaining similar lists maintained by the judicial magistrates concerned.

The High Court Registry was directed to circulate a copy of the present judgement to the DGP and all Principal Sessions Judges.

In so far as the contempt petitioner was concerned, the judge closed the case after recording the Inspector's submission that the investigation would be completed within two months.
