CHENNAI: The Madras High Court has ordered transfer to the CB CID, a case pending with the Voimedu police station in Nagapattinam district relating to the alleged attack on the drivers of two advocates by a gang in September this year. In his petition, T.P. Senthilkumar, advocate, stated that he was at his native place discussing some cases with another advocate, V. Kasinathabharathi, at the latter's office in Marudhur village when the incident took place. Around 9.30 p.m., L.S.E. Palaniappan, along with other persons armed with deadly weapons, chased him and his colleague. They scaled a compound wall and had a narrow escape. The gangsters attacked the drivers of their cars and also damaged a vehicle. The drivers were taken to hospital and, based on the statement of the petitioner's driver, the Voimedu police registered a case. S. Prabakaran, senior counsel for the petitioner, submitted that even after registering the case against the accused, the police had not taken steps to secure them. Some powerful persons were compelling the force to delete Palaniappan's name from the case. If this is allowed, the petitioner will not be able to get justice. He urged the court to direct the CB CID to take up the investigation. Justice T. Mathivanan said that he had gone through the material produced. On considering the facts and circumstances, he was of the firm view that the interference of the court was indispensably necessary. Otherwise, it would result in miscarriage of justice. Accordingly, he ordered the transfer of the case to the CB CID for investigation. By another order, Mr. Justice Mathivanan quashed an FIR registered this year by the Voimedu police against Mr. Kasinathabharathi and others. Mr. Kasinathabharathi had submitted that Palaniappan, through his men, had preferred a false complaint against the petitioner. The police had registered a case against the petitioner and others for offences, including attempt to murder.
