Order on NIMS admissions set aside

HYDERABAD: A Division Bench of the High Court comprising Chief Justice Nissar Ahmad Kakru and Justice Vilas V. Afzalpurkar, on Wednesday, set aside the interim order passed by a single judge directing the Nizam's Institute of Medical Sciences (NIMS) to admit students who won the case in an earlier writ petition.

NIMS had provided reservation for in-service candidates in super-specialty courses, though the Medical Council of India prohibits such quota. Mamatha Reddy and others had challenged the reservation and a single judge declared it illegal. After scoring success, the petitioners filed a fresh case seeking a direction to grant them admission.

They complained that the authorities had delayed the admission process intentionally. Another single judge had said that the students be given admission and posted the main writ petition for final hearing.

NIMS had filed a writ appeal contending that as per a Supreme Court order, no admissions could take place after September 30. Hence the latest interim order directing authorities to give admission was not proper. The bench considered the Supreme Court direction and said that such admission could not be given.
