Court notices to three IAS officers

“To explain why according to them the Delhi Lokayukta could not probe corruption charges against them”


NEW DELHI: The Delhi High Court on Monday issued notices to three IAS officers here to explain why according to them the Delhi Lokayukta could not probe corruption charges against them.

A Division Bench of the Court comprising Justice Dipak Misra and Justice Sanjeev Khanna issued the notices to three IAS officers -- R K Saxena, Chetan B Sanghi and Ravinder Balwani — on an appeal filed by the Delhi Lokayukta, former Delhi High Court Judge, Justice Manmohan Sarin, against a Single Bench order in the matter.

The Division Bench directed the three officers to file replies to the petition by March 17.

Allowing a petition by the three IAS officers challenging the jurisdiction of the Lokayukta to probe allegations of corruption against them, Justice Muralidhar had asked the Lokayukta last November to stop the proceedings against them.

The officers had argued that they had immunity from probe by the Lokayukta under the Delhi Lokayukta and Uplokayukta Act.

The Lokayukta had initiated the probe against the three officers on three separate private complaints.

In the appeal, Justice Sarin (retd) submitted that he had the jurisdiction to investigate corruption charges against the IAS officers and put his finding on record.

Justice Sarin is also unhappy with Justice Muralidhar for not allowing him to be a party to the petition. He said in the appeal that he just wanted to address the Court on the jurisdiction of the Lokayukta.
