DMK rebuts Swamy's claim

CHENNAI: The DMK on Monday sought to rebut Janata Party leader Subramanian Swamy's claim that he could not be sued by Chief Minister M. Karunanidhi based on his accusation in a Delhi court that the latter was involved in the 2G scam.
Responding to Dr. Swamy's contention that no defamation case would arise out of an accusation made as part of judicial proceedings, DMK deputy general secretary and State Law Minister Durai Murugan said in a statement that the legal notice sent on behalf of Mr. Karunanidhi pertained to the Janata Party leader's allegation made to the media and not any point made in court.
“We are quite aware that it is not possible to take legal action about what was said in court,” Mr. Durai Murugan said.
Dr. Swamy claimed that the attempt to sue him would fail. Mr. Karunanidhi had filed a defamation case earlier and lost it in 2005, “because of his refusal to enter the witness box.” The same fate awaited him on this notice too.
