De-recognition of Air India union set aside

New Delhi: De-recognition of the Air Corporation Employees' Union by the Air India management for going on strike last year has been set aside by the Delhi High Court, which said the action was taken without following due procedures.

A single-member Bench of Justice S. Muralidhar set aside the decision of the national air carrier management observing that principles of natural justice were not followed as the union was not provided an opportunity before the disciplinary action was taken.

“This court holds that the impugned order, dated May 26, 2010, de-recognising the union is bad in law as it was passed without any show-cause notice to the petitioner union and without affording the petitioner an opportunity of being heard,” the Court said.

The union had filed a petition challenging the Air India notice de-recognising it. — PTI
