Lalgudi DEO's order set aside

CHENNAI: The Madurai Bench of the Madras High Court has come to the rescue of a person, whose application seeking appointment on compassionate grounds, following the death of his father, was rejected owing to delay in submitting it.

Allowing a petition challenging an order of the District Educational Officer (DEO), Lalgudi, in Tiruchirappalli district, Justice V. Dhanapalan directed the authorities to consider the claim without reference to the objection raised in the impugned order, but considering the fact that the sudden death of the petitioner's father had left his family in penury and without any means of livelihood, and pass appropriate orders within two months. A. Musthfa Iqbal Basha stated that his father Abdul Hafeez was working as B.T. Assistant in Government Higher Secondary School, Sirugambur. He died on October 15, 1993 while in service. The petitioner was then aged 13 years and studying in Standard VIII.

He completed SSLC in 1995. After attaining majority, he submitted an application to the DEO seeking appointment on compassionate grounds.

The official by an order dated November 6, 2009, rejected his application as there was a delay of nearly six years in submitting it.

Setting aside the impugned order, the Judge said it was seen from the records that the petitioner's two sisters were married and the brother was living separately. Now, those left out in the family are the petitioner and his mother, who were without job. In the given situation, it is very difficult for them to get two square meals a day. Therefore, he was of the considered opinion that the family of the deceased government servant could not be left in the lurch.
