Directive to government on creating infrastructure

CHENNAI: The Madras High Court has directed the Tamil Nadu government to provide infrastructure and machinery for the effective implementation and enforcement of awards or orders passed by the Labour Courts and Industrial Tribunal, within three months.

Justice K. Chandru gave the direction while allowing two petitions.

While one petition prayed for a direction to the authorities to create the necessary infrastructure, the other prayed for a direction to the Labour Secretary to number an execution petition (EP).

The Labour Court returned the EP filed by the petitioner to implement its award on the ground that no G.O. had been issued granting powers to Labour Courts to do so.

Having created the powers for the Labour Courts, the government should also provide the supporting machinery, lest workmen be left high and dry, he said.
