Kochi: The admission to postgraduate medical courses in self-financing private medical colleges was not permissible after May 31 of the academic year, according to an affidavit filed by the Medical Council of India (MCI) before the Kerala High Court. The affidavit was filed in response to a writ petition challenging the admission to government quota in the postgraduate courses in the self-financing medical colleges in the State. Statutory regulations The MCI reiterated in the affidavit that statutory regulations of the council and directions of the Supreme Court made it mandatory that all the postgraduate admission in private medical colleges should be completed before May 31. It also pointed out that the Supreme Court order extending the last date of the admission to June 30, 2011 for the academic year 2011-12 was not applicable to private medical colleges. The Supreme Court passed the order as there were some difficulties in filling seats of all India quota within the time schedule. The last date for admission to all India quota was extended since the all India quota could not be filled by May 31. The MCI also submitted that carrying forward of any unfilled seats of one academic year to the next academic year was not permissible in view of the Supreme Court rulings. Apex court ruling The affidavit said that the Supreme Court had also ordered that if any private medical colleges granted admission to its management quota in excess of the prescribed quota, the management quota would stand reduced in the next year to make up for the excess admission made in the previous year. Besides, no admission could be made without complying with the minimum eligibility criteria laid down by the MCI Postgraduate Regulations 2000. The admission had to be made within the annual intake capacity fixed by the MCI. Federation's stance The Kerala Christian Professional College Managements Federation had submitted that the managements decided to fill the 50 per cent government quota after the government failed to allot students to these seats despite repeated reminders. In an affidavit, the Federation said after finalising the fee structure, the managements wrote to the State government requesting to allot students to the government quota before May 16 so that managements could complete admission by May 31, the deadline set by the MCI.
