Bangalore: The Karnataka High Court on Monday upheld the order of the Special Court for CBI cases, which in 2003 acquitted the former Chief Minister S. Bangarappa and the former Additional Chief Secretary J. Alexander from all charges, including corruption and receipt of kickbacks, in the case known as “Classik Computer” scam. Justice V. Jagannathan delivered the verdict while dismissing the appeal filed by the Central Bureau of Investigation (CBI) against the September 19, 2003 order of the Special Court for CBI cases. The High Court found no reason to interfere in the judgment of the trial court, which had said that there was no ingredient to convict the accused either for criminal conspiracy or under the provisions of the Prevention of Corruption Act. It was the case of CBI that Mr. Bangarappa and Mr. Alexander, with the object of causing pecuniary advantage to one V. Gokul Krishna of Classik Computer System, and to them, had awarded the contract of supplying 100 numbers of Apple Macintosh Computer System at a cost of Rs. 5.71 lakh per unit It was alleged Classik Computer System had submitted details of price on March 31, 1992 and on the same day it was approved and notification was issued in violation of norms without seeking the view of technical advisory panel. The CBI had also alleged that the accused public servants had received kickbacks from Classik Computer System. The CBI had registered the first information report on March 19, 2003 based on a complaint filed by the then Chief Secretary J.C. Lynn following State Government decision to handover to the CBI the investigation of the case. The CBI filed the charge sheet on July 27, 1994.
