Kozhikode: The Special Additional District Sessions Court (Marad Cases) here acquitted 15 persons in a case filed for setting a house ablaze during the communal riots at the seaside village of Marad in January 2002. Pronouncing the judgment here on Tuesday, special judge R. Narayana Pisharody set free the accused after the prosecution failed to prove the charges against them. The house of Thekkethodi Sujitha was set ablaze on January 3, 2002. She had claimed a compensation of Rs.1.25 lakh. Those acquitted are T. Abbas; T. Kasmi; Hamsa Koya; T. Shafi; Ahamed Koya; Mohammed Ali; S. Karim; Moideen Koya; S. Ziyaudeen; T. Majeed; P.T. Basheer; S. Kasim; S. Ali Koya; P. Nizar; and P. Shamsu. T. Aboobacker, another accused, died during trial. The Beypore police had registered the case. The accused were charged under sections 436 (mischief by fire or explosives with intent to destroy house); 427 (mischief causing damage); 147 (rioting); 143 (unlawful assembly); and 153-A (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language and doing acts prejudicial to maintenance of harmony) of the Indian Penal Code.
