UK visas: new appeals procedure for students


Genuine students now have the opportunity to demonstrate that they meet Immigration Rules in time to start their course.

Students who are seeking entry clearance to study in the U.K. but have been refused a visa and wish to appeal against the decision can meet Visa Officers from the British Deputy High Commission in Chennai on July 4 at the British Council Division, 737 Anna Salai, Chennai.

This first-of-its-kind initiative is a unique global pilot, a press release said. This will be periodically reviewed and if successful, will run through the student season, from July until September 2007. Visa Officers will review the appeals and a decision will be made within 10 working days, in terms of upholding or overturning the decision to refuse.

Kevin Woods, Head of the Visa Department in Chennai, said, “Students are often refused entry clearance because they have received bad advice and have not prepared their application well. Through this pilot, genuine students have the opportunity to demonstrate that they meet Immigration Rules in time to start their course.”

Mr. Woods added, “Over the past two years, we have worked closely with the British Council and around 80 student agents to establish a Trusted Partnership network across India. We encourage students to log on to www.ukinindia.com for information and to apply early.” Students who are eligible should contact British Council, Chennai at 044 4205 0662 by 4 p.m. on July 3. Appointments will be booked only for those who meet the eligibility criteria.

Students with appointments must bring with them:

A fully completed AIT 2 appeal form (this form is included with the refusal notice).

Original passport.

Documentary evidence that addresses the reasons for refusal.

Original documents to show that the course has not yet started or that they have obtained permission to join late.

The new arrangement is not open to students who have been refused and wish to make a fresh application through the normal channels (as opposed to making an appeal), the release added.
