Landmark judgments
Ensuring rights and better amenities (water supply, food and hygienic conditions) in all women’s prisons in Tamil Nadu by the Madras High Court, following the filing of a writ petition, is a milestone. The judgment pronounced by Justice Chandru striking down a GO which did not allow the children of unwed mothers to claim death-cum-retirement benefits and get job appointments on compassionate grounds is another landmark ruling. As per the GO, illegitimate children could claim benefits through their father, but not through their biological mother. In 2008, I would like to see Lakshmi’s case, a complaint of sexual harassment made against a minister in Kerala, resolved. The police are yet to file a charge sheet in the case. The TN State Women’s Commission should get statutory power, stalking should be made an offence and the definition of rape widened to include sexual assault.
