Encroachers on the prowl

The lower and middle class sections who bought plots in unauthorised layouts are being targeted by people with muscle, money and political clout, says M.L. Melly Maitreyi

Beware. A new tribe of land encroachers are on the prowl.

If encroaching prime Government land and getting away with it later by regularising it for a nominal price by those who could wield muscle, money and political power is one side of the story, a disturbing scenario is unfolding in the twin cities and s urrounding municipalities (now part of Greater Hyderabad Municipal Corporation) witnessing a real estate boom.

The prey in this modus operandi are small and middle class people who had bought housing plots in unauthorised layouts years ago and may have been thinking they are sitting pretty with registration documents in their possession.

But several such individuals may be in for a jolt when they realise that some one else staked claim on the land, disputing either the title or the survey number.

The claims more often that not are on the basis of tampered documents with no proper computerisation of land records in many mandal revenue offices and offices of sub-registrars.

“It has become a new game plan for some to eye plots with potential and create a dispute deliberately and then give a Hobson’s choice to the original buyer with valid documents to settle for a compromise at a price suggested (read dictated) by these manipulators or prepare for a long haul in the court rooms if prepared to settle the civil dispute legally,” says a realtor.

The government apathy is only encouraging such unscrupulous practices, lament many an aggrieved buyer. Seconding the opinion, Y. Kiron of Suchir India too feels that it is also government’s responsibility to ensure that when an individual pays the registration fee and gets the plot registered in his/her name, it signals that the land is transferred to the buyer. Yet litigations, some times genuine and sometimes manipulated are on the rise and not every one would have the wherewithal to go to court of law, take an injunction and retrieve their land, he says.

Why such a situation should occur in the first place? If the authorities concerned educate and caution the buyers about the set of procedures to be followed, it would not give room to such malafide manipulations later by any one, he says.

District Registrar Gangadhar Reddy says the Registration Act is available to every one and it is the duty of the purchaser to read it thoroughly and verify the authenticity of the transaction. “When a buyer asks us, we do give necessary information,” he says.

In case of typographical errors, be in the name of title holder, Survey No., boundaries etc., rectification would be carried out.

If the vendor had misled ignorant purchaser about the authenticity of the deal, then criminal case should be filed against the vendor as per sec.169 of CrPc.

If the Registration department is empowered, then legality of the documents could be verified before registering to rule out malpractices.
