Build your top floors within stipulated time or pay penalty

I have a plot of land in Tarnaka and I obtained permission to build ground plus two floors in 2000. All the fees and other formalities were completed for obtaining the permission. I started the construction in 2000 itself and completed the ground floor. I raised pillars for the second floor but could not complete it due to shortage of funds and non receipt of bank loan.
Meanwhile, I was transferred out of Hyderabad in 2002 and the work was unfinished. On returning, I decided to finish the two floors above the ground floor. I took up the matter with MCH and was orally told go ahead since I already have permission. Can you please clarify to me whether construction of two floors above ground floor, comes under CDS?

Greater Hyderabad Municipal Corporation replies: Since you have not completed the building within 3 years from the date of obtaining the building permission, the upper two floors will be treated as unauthorised floors and penalty shall be paid for the two floors.

We are purchasing a newly constructed house a few kms away from Mehdipatnam. The building was constructed well before December 15th 2007, but the documents showed discrepancies such as no layout approval and no construction permission. The builder has already obtained a municipal number for the house and has paid the tax and the Government challan has ‘unauthorised construction’ duly printed on the top centre of the tax receipt. The registration of sale deed is slated and we want to apply for regularisation of unapproved plot and unauthorised building. Please clarify and also please state the rate for penalisation.

Malakpet. GHMC replies: If your building is constructed by 15.12.2007 you can apply under BPS by paying the penalty as per the rates of penalisation charges given in Table-A & B of BPS GO (which is available in hand book of guidelines for BPS / LRS schemes).

I purchased the flat no.506, Amrapal Arcade, M.No.3-6-688/1, Street no.10, Himayat Nagar in the year 2007 from the original owner. The property has been duly registered in my name and got the mutation vide your letter No.108/TC3/GHMC/2007 DATED 13.08.2007. At the time of purchase the owner handed over me all the original documents and also BRS approval letter No.8225/BRS/HO/98 dated 31.08.1998 issued by Chief City Planner, M.C.H. However I observe from my records the original revised copy of the approved plan is not available. Can you inform the procedure to obtain the revised approved plan of my above flat.

GHMC replies: The certified copy of the sanctioned plan / regularised plan can be obtained from the GHMC on payment of requisite fee.

I have been allotted a house (the size of the plot is 112 sq yards by Employee Housing Society colony) under ownership basis and it was registered on my name. The layout was approved by HUDA and the construction of housing scheme was financed by HDFC. We purchased one more house from my colleague which is adjacent to my house (both the houses are under one roof / common roof ). This house was registered on my wife’s name. Subsequently, both the houses were extended on the ground floor and we constructed the first floor (with typical plan) without disturbing the existing roof (since it is common roof) and the plan was approved by the municipal authorities and loan also obtained from LIC Housing Finance. Further, we have constructed (in the year 2006-07) second floor and a small pent house measuring 25 per cent of the total plinth area. The second floor and penthouse has no approval from Municipal authorities.
Do we have to apply separately, both me and my wife, for regularisation, ? Or only one application (either me or my wife) by transferring the title rights to one name can be made? Does the deviation for set backs apply between the two houses. What is the initial amount supposed to paid along with application if applied for regularisation?

Both of you have to apply together for regularisation of deviation made in first floor and unauthorised second floor and pent house and a minimum of Rs.20,000 shall be paid along with the application.
