Sanctioned constructions do not invite penalty

Q. We purchased plots in a layout in Survey No.97/A at Gachibowli under Serilingampally Municipality, RR District. After getting due permissions from the municipal authorities, we constructed houses in our plots and are regularly paying house taxes . There are no tax arrears to date. Please clarify whether this layout comes under the category of unapproved layouts. If so do we need to get it regularised under LRS?

Greater Hyderabad Municipal Corporation (GHMC) replies: If permission for construction was obtained and if it was carried out as per the sanctioned plan, then it will not be treated as unauthorised construction.

Q. I wish to obtain clarifications on two issues very pertaining LRS . It is mentioned in the LRS booklet, plots in villages covered by GO No.111 would not be taken up for regularisation. But it is not clear whether plots in residential zone (as declared by HUDA in their draft master plan) of these villages (covered by GO No:111) can be regularised.

It was stated by the government that the money collected through LRS will be used for development of the layouts. It is also mentioned in the LRS booklet that even plots in layouts having draft approval of HUDA (generally called tentative approval) need to be regularised. We have a plot in layout tentatively approved by HUDA and which was developed fully but was not granted final approval. Please inform whether we have to pay full amount of penalisation (for the plot in fully developed layout) in view of the fact that the penalisation amount is meant for development of layouts?

GHMC replies: The plots covered under GO 111 will not be considered for regularisation.

Q. Me and my wife are senior citizens and have acquired a flat with three bedrooms. The builder has constructed only ten flats with uniform area of 1,809 sft.

When I enquired about BPS and CDS, he replied that he constructed the flats as per HMC approved plan viz., two units per floor, five floors and setback as per norms of HMC. No penthouse or room on terrace is there. Is it necessary for me to apply for BPS.

No notice was issued to me by the GHMC and I feel there is no need for me to file BPS as there are no deviations in my flat. Also, can Welfare Associations give one DD or Bankers Cheque to GHMC if the area is same for all the flats in case of deviations?

GHMC replies: when there no deviations, there is no need to seek regularisation. You can examine the building and check if it was built according to sanctioned plan or if there are any deviations.

If there are deviations, then regularisation has to be applied for.

If in the same place and similar deviations, the flat owners can come together and seek regularisation and apply accordingly.

Q. How many floors construction permission can be given by Gram Panchayats in layouts approved about 10 to 15 years back? Or they have to be regularised as per new GO?

Generally, 300-400 sq.yd lots are given permission for single unit. Can we make it into two units making internal changes without violating the norms? What is the minimum plot size required to construct two or more units?

GHMC replies: As of now, there are no restrictions on minimum area for constructing an apartment.
