The PUCL has contended that 13-year-old Muneer's detention, without registering any case against him, was in violation of the Juvenile Justice Act and Articles 14 (equality before law), 21 (protection of life and personal liberty) and 22 (protection against detention) of the Constitution applicable to all persons regardless of nationality. "There has been a complete breakdown of the juvenile justice system in Muneer's case. He has been incarcerated in the police lock-up since June 26 without being produced before a magistrate or the Juvenile Justice Board," Prem Krishna Sharma, president of the State unit of PUCL and a lawyer, said. A Division Bench, comprising Justice Y.R. Meena and Justice Shashikant Sharma, issued notices while directing the respondents to submit their reply within four weeks.
